—Minimum Age: Tpe third proposal provides that the minimum age at which a youth can be tried as an adult for the commission of any felony be lowered from 15 to 14 years of age, the minimum age used in most states. Coleman noted that 14 is the common law age of accountability, and until 1973 this was the law in Virginia.
—Future Offenses: The fourth proposal requires a youth of 16 or 17, who has previously been tried as an adult for the crimes of rape, murder, robbery or sodomy by force, to be treated as an adult for any future misdemeanor or felony charges.
“Youthful offenders account for a substantial number of crimes committed,” Coleman said. “Youths under 18 commit about one third of the burglaries in Virginia, one sixth of the robberies and one tenth of the rapes and serious assaults. Many of these youngsters are repeat offenders who use the juvenile justice system, confident that they will be granted the protections offered by it.
