After reading the previously sealed record in the Kidwell case, David Konick, Diane Kidwell's former lawyer and candidate for commonwealth’s attorney in the upcoming election, requested the opportunity to respond.
“There’s no question that I made a mistake by handling the shotgun in the course of turning it, over to the State Police,” said Konick, reading from a prepared statement in an interview in his office late Tuesday afternoon.
“In some people’s minds this incident raises questions about my honesty and integrity. Honesty and integrity do not prevent a person from ever making mistakes. The question is what you do after you’ve made a mistake.
“When it came to my attention that there were apparently no fingerprints on the shotgun and after consultation with Mr. Dowd and Mr. Leffler (Kidwell’s attorneys), I made a full and forthright disclosure of my actions t,o the commonwealth’s attorney and to the Virginia State Bar. As I understand and as the record makes clear, the fingerprints or lack of fingerprints were never a material issue in the case in either trial.
“My actions violated no laws of the Commonwealth. I commited no crime. I had no criminal intent what so ever and none of my actions were taken with any intent to obstruct or impede the investigation of the case or the judicial process.
