Didn’t Aim
Under cross examination by special prosecutor Steven Merril, Kidwell maintained she didn’t aim the gun. “I just fired...I didn’t want to shoot him. I was trying to save my life.”
Addressing Kidwell’s contention that she took the gun down to the truck for protection, Merril asked if she thought Spellman was going to bulldoze her house.
I had a right to protect my property,” she said, agreeing, however, that Spellman’s work with the bulldozer stayed entirely within the 50 foot deeded roadway.
Testy but controlled under the cross examination, Kidwell acknowledged that she didn’t want or need the roadway any wider; that she knew as early as September that Saltonstall intended to widen it. ‘‘There’s nothing in that deed that says she can widen the road... There’s nothing that says it has to be 50 feet.”
“While he was on that bulldozer and the bulldozer was still running, you thought Ranee Spellman was going to shoot you through the cab of your truck in front of all those people (Kidwell’s husband, brother and children) who were running around?” asked Merril.
