A request by Dale Miller Davis to build a carport on a nonconforming lot was rejected for the same reason.
Davis was not able to prove that it would be an undue hardship not to build the carport nor that his was an unusual case.
"I have just bought a new car," he explained. “It’s a blue car. The color is fragile to sunlight." Davis hoped to convince the board that denial of his request would “approach unreasonable confiscation" of his property by threatening the value of his new car. His attempt failed. After the board refused him the permit, Davis shook hands all around and thanked the board members for their time.
