In earlier cross examination, Kidwell said that when his wife shot Spellman, he was at the back door of their house, drinking a cup of coffee, “looking, watching.” Demonstrating the position of Spellman’s hands, he stuck his right hand underneath an imaginary vest.
Referring to a statement Kidw’ell gave the police the day after the shooting, Merril asked if his memory was better then.
“It should have been better that day. However, it was quite upsetting.”
The prosecutor asked if Kidwell had told police Spellman's hands w'ere “in •about the middle of his chest, away from his body” right after the shot was fired?
“I told them the same thing I showed you,” Kidwell replied, again reaching inside an imaginary vest. However, reading from the transcript of his statement to the police, Kidwell said: “It looked like both hands w'ere up in this area (almost on his chest). It looked like they were out aw-ay from his body.” Under further questioning, the defendant’s husband acknowledged that no where in his statement to police the day after the shooting did he say Spellman had his hand in his vest.
Called to the stand as a prosecution witness, Rappahannock Sheriff W. A. Buntin testified that he never told Diane Kidw'ell during their telephone conversation the morning of November 9 that he would not mess with Ranee Spellman. Buntin said that he never told Kidwell he’d had Drior Drohlems
