Joseph Baker Deal was found guilty in General District Court on Tuesday of passing on a double line. State Trooper Harry A. Newlin had charged Deal with the offense on June 29.
Trooper Newlin testified that he had stopped a vehicle on Route 211 and had a DWI suspect in custody when he prepared to pull on to the road in an unmarked state police car. “I saw headlights behind me, but they were far enough behind that I judged I would have enough time to pull out,” he said.
After he pulled out on 211, Trooper Newlin said that he had accelerated to 30-40 mph before the other vehicle approached and passed him on a solid double line. The other vehicle was operated by Deal.
Deal testified that he saw vehicles parked on the side of 211, and that he was 15-20 feet from them when one pulled out on the road. He said that he passed the car in an effort to avoid a collision.
“There would have been no way for you to avoid his car if you were going 50 to 55 and he pulled out 15 to 20 feet ahead of you,” said Judge John Alexander. Judge Alexander found Deal guilty and fined him $25 in addition to $20 court costs.
