By unanimous vote, the Planning Commissioners recommended that the BZA issue the special use permit with only those conditions specified by Commissioner Fannon.
In other action, the Planning Commissioners voted 4-1, with Werner Krebser opposed, to recommend issuance of a special use permit to Mary L. Payne for a second dwelling on a 148 acre farm near Amissville. “Someday, I may not be able to navigate steps,” said Mrs. Payne, noting that the new house will be a single story residence and would be rented in the interim.
Commissioner Krebser’s objection centered on the close proximity of the proposed residence to the existing house on the property. He pointed out that minimum lot size in that zoning district is 25 acres. “What you’re doing is putting two houses on very small acreage,” he said.
With James Swindler abstaining, the Commissioners recommended approval of an amendment to the subdivision ordinance which would revise wording to authorize an exception to the ordinance’s general regulations in “unusual circumstances” or when strict application would result in hardship or injustice. The Commissioners recommended addition of a provision for a public hearing on requests for exceptions with written notice of the application to be given to adjoining landowners. With Mr. Swindler again abstaining, they voted to make no recommendation on a second proposed amendment which would eliminate the right to appeal approval of a subdivision to the circuit court.
