Farmers who hire labor are just like others in business, they have to verify that the employees can legally work. The Immigration Reform and Control Act of 1986 makes it illegal for you to knowingly hire or recruit a person not authorized to work in the United States. It also requires you to verify the employment status of every employee, whether citizen or alien, according to Virginia Extension spokesman Bland Franklin.
A person who violates this rule could receive large fines or a jail sentence.
You verify that the applicants can legally work by having them complete Employment Eligibility Form (Form 1-9), Mr. Franklin said. The applicants also have to present verifying documents, such as Social Security card, driver’s license or other legally acceptable document.
The employer has to examine the documents, even if the applicants are well known. Workers who have been employed by you in the past don’t have to fill out an 1-9 for re-employment.
