The community’s debate over the ARB’s decision on the proposed addition to the jail raised a number of issues that deserve serious consideration, but which were not relevant to the issue addressed by the ARB.
That issue, the only issue before the ARB, was, in effect, whether the proposed addition was consistent with the preservation of one of the town’s historic buildings, which in turn, according to John Wells, architectural historian with the State Division of Historic Landmarks, is “part of the courthouse complex-the seat of the county’s identity.”
The ARB was created by the Town Council to preside over issues of this sort. It had the authority to act as it did, and there was no showing, either by Council members or by the public, that was wrong in its judgement. On the issue that was before them, the ARB should have been upheld, or, if its decision was in error, the Council should have said so and pointed out its reasons so that the ARB could act on future applications in a manner consistent wdth the Council’s instructions.
