“In all likelihood, the basins are continuing to contaminate," admitted Ludzia.

“This is a very serious matter," said Wayne R. Walters, assistant regional council for the EPA. He added that the cleanup process will be fully overseen by the EPA.

The rayon manufacturing company is also under the eyes of the state. Avtex was given one year to meet state standards for carbon disulfide emissions after failing to convince the State Air Pollution Control Board that its emissions levels were safe for human health.

The company also awaits a state circuit court judge’s response to the State Water Control Boards charges that Avtex violated an agreement with the state to cease polluting the South Eork of the river.

While the company admits that its water pollution continued, it argues that the pollution was caused by unforeseeable leaks and breakdowns at the plant. The judge is expected to respond early next month.

If found in violation of the consent decree and forced to pay the $2 million fine immediately, the company would be forced to shut down, according Avtex Lawyer Timothy G. Hayes.
