You must get the 1-9 completed within three business days after hiring an employee, or at the end of the first day if the job is for fewer than three days. The form must be kept for three days or for one year after the employee is terminated, whichever is longer.
Qualified aliens list an alien registration number by the third check box of the 1-9.
If the number is in the A-9 million series, the employer must also complete a form ESA-92 quarterly. The ESA-92 shows hours worked and tasks performed.
This form helps officials decide how many migrant workers to admit to the country. The form can be obtained at The Rappahannock County Extension office, 675-3619.
Contract labor doesn’t need to complete an 1-9. “Contract” means the workers furnish their own tools and supplies and complete a job unsupervised.
Be sure not to discriminate against eligible noncitizens or qualified local workers when advertising for help or when hiring, Mr. Franklin added.
