The State Water Control Board released test results on Monday that pinpointed the rayon producing plant as the source of the Shenandoah's PCB pollution. Based on the results of 51 river bank soil samples, the 50-page document concluded: “This study eliminated all potential sources of PCBs except for Avtex.”
As the SWCB study was being released in Richmond, Virginia State Police investigators were serving a search warrant at the plant in Front Royal, demanding all the company's records relating to its handling of PCBs at the facility. The investigators spent about two hours at the plant, and left with boxes of documents, according to witnesses at the scene.
Ms. Terry's request, filed Monday afternoon in the Richmond Circuit Court, asks that unless Avtex can prove it has the financial capability to fund PCB and river cleanup operations in addition to paying fines levied against it for the contamination, “Avtex (will be) no longer capable of operating its facility in Virginia.”
