Nash variance

The Board of Zoning Appeals postponed action on Sally Nash’s request for a variance to the set-back requirements for her house at the request of the builder, Sam Clifton, who could not be present at last Wednesday’s meeting. Ms. Nash was not present either.
In discussing whether to postpone hearing the case, it was apparent the BZA members are looking for alternatives to either granting or denying variances in such cases. Chairman Lee Bird wanted to know if it would be possible to change the procedures so a fine could be imposed. I
The problem arose, according to papers filed by Ms. Nash and Mr. Clifton, because the property on Route 600 west of Sperryville is located in a Conservation zone, which requires that a building be set back 100 feet from any property line. Mr. Clifton, the contractor, had built several houses before, but always on property that only required 50-foot setbacks. He told the Planning Commission at its hearing on Aug. 16 that he had not read on the building permit, which he signed, that 100-foot setbacks would be required for this house.
