plant did not have the resources to “protect its workers, clean up its pollution problems, and provide for further on-site upgrades” in its aging equipment.
“Since they can’t do it all,” he said., “we’re asking that they address the environment. If that means they can’t take care of the workers’ health and safety, then there can simply be no workers at the plant.”
“It’s time for the environment to take precedent,” he said.
Monday’s pleadings also contained the following motions:
• That civil charges be filed against Avtex for the illegal discharge of the cancer-causing agent into the river.
• A requirement to immediately cease anv further discharge of the PCBs.
• A requirement that Avtex fund PCB cleanup, including both an onsite eotamination of 78 parts per million of the chemical, and river bank contaminants of up to 38 parts per million.
• A motion to recover damages to the environment, including payment to the Commonwealth for loss of the beneficial uses of the South Fork of the river (particularly sport fishing), and for the menance to public health.
Bert Roher, spokeman for the attorney general’s office, said that his office had not yet set the amount of damages it would require Avtex to pay.
