The Decision-Making Process

The Planning Commission unanimously recommended approval of the subdivision on the preliminary plat and requested information for its approval of the final plat. The applicants failed to provide that information before the public hearing by the Commission closed. It was only then that the unamimous recommen dation for approval of the application by the Planning Commission became a recommendation for disapproval.

The applicants submitted the information requested by the Planning Commission to the Town Attorney, because the Planning Commission had completed its action on the application. At the public hearing before Council, both Mr. Morehouse, speaking for the applicants, and the Town Attorney, publicly reviewed with the Council what was provided in response to each request.

The requests required documentary information, and, for cne most part, legal documents - such as incorporation papers for a Homeowners’ Association to maintain a private street and deeds of easement to ensure access to off-site drainfields by owners.

Both the applicant and Town Attorney confirmed that all the information requests had been satisfied. No, the Council did not read the articles for incorporation or the easement deeds. We directed the Town Attorney to do so and to indicate that each document legally complied
