tion. The strict compliance with the ordinance could have resulted in drainfields in marginal locations. The Coucil determined the public interest to be best secured by allowing all drainfields to be located where best performance was assured, for both a primary and an alternate drainfield for every lot.
The waiver to allow off-site drainfields — in locations approved by the State Health Department, as to soil types and drainage conditions - for the lots for which drainfields might have been marginal was granted specifically to ensure that failures of drainfields in the future would not create a need or a demand for a public sewer system.
The precedent the Council set by granting this waiver is a precedent that is in the public interest, not just for this subdivision, but for every Town property owner. It must be anticipated that old septic systems in Town, located on much smaller lots than in this subdivision, will have to be relocated as they fail. If the Town precedent is to forbid relocation of drainfields off the lot, then the only alternative for the Town when that happens is a public sewer system none of us wants or can afford.
Minimum Lot Size
This subdivision resulted in seven lots of record, all but one of which are more than 1.5 acres in size. There is a lot of less than half an acre, U.41S1 acre, as Mr. Miller stated.
