since the building was to be so far away from the existing house, it might become a separate parcel of land in spite of the fact that the zoning ordinance would not allow the land to be divided.
He said that the BZA could put . conditions on the permit that would make subdivision less likely, such as requiring that the new structure be closer to the main building and share the septic system. A family apartment should be a “dependency” of the main house, he said.
Douglas Baumgardner, representing the Lees, pointed out that the location had been picked to afford both generations of the Lees privacy and so both the garage and ' the apartment could be on or near i ground level. The location will allow - the building tobebuiltintoahill.
Mrs. Lee pointed out that they also had to avoid putting the building or roadway over their septic field.
