Mr. Luke said that the victim was the son of Mr. Eppaiu's girlfriend, and that Mr. Eppard had committed oral sodomy on the victim and had fondled the victim’s penis with his hands.
Before sentencing, Judge Penn told Mr. Eppard that with crimes of this nature there is a great deal of tendency, or compulsion, to repeat that contact. He also said, “Be assured that if you come back into society and do this again, you will have that 20 years (suspended sentence) looking at you. Despite the counselling you have, you will have a desire for young children.”
Mr. Eppard is to have no contact with the victim without written consent of his parole officer and the victim and his mother. He must also pay the costs of his court proceedings within six months after his release from incarceration, and be registered with the Virginia State Police, which is a requirement for certain sex offenders in this state.
