The Grand Jury handed down just one indictment on Term Day last Wednesday.
Yvette Maria Burke, 31, of Boston, was indicted for two felonies, grand larceny and possession of a firearm after having been convicted a felon. According to the court file, Merita Neighbors charged that Ms. Burke had pawned a Nikon 6006 camera, lens and case which she had left at Ms. Burke’s house for safekeeping.
Randall Linden Ramey, 25, of Sperryville, was in court last Wednesday on a violation of probation charge. He was convicted in August 1994 of distribution of a Schedule II drug to a minor, possession of PCP and possession of a weapon. At that time he was sentenced to 13 years, eight years suspended, and was released to the Culpeper probation office in August, 1995.
Diane Moore, his probation officer, testified that Mr. Ramey had two urine samples in February which tested positive for marijuana and another positive screen in April. She said she felt this was a very serious violation, that probation is a privilege.
Mr. Ramey’s attorney, Douglas Baumgardner, argued that Mr. Ramey’s two screens in February were one week apart and they may have tested positive from just one use. He told Judge Selwyn Smith that two of Mr. Ramey’s problems have been poor judgment and bad peers.
Mr. Ramey admitted that he had a substance abuse problem and pleaded with the court to allow him to attend Boxwood. He told Judge Smith that he needs to make a turn in life and that he had learned that jail is not the place he wants to be. Also, he said, his parents do not deserve what he had put them through.
Mr. Ramey’s girlfriend, Lisa Rogers, testified to Mr. Ramey’s dedication to change his life around and said she had been a good influence on him.
Judge Smith found Mr. Ramey in violation of probation, but is allowing him to continue on probation and told him to attend Boxwood at his own expense. Mr. Ramey must return to the court in September for review.
