Remember, all during the 1700s, much of this area was frontier. Some folks bought chunks of it from the parties above; some were granted plots for service in the Revolution, others thought that it was just open space available for common use. Whatever the reason, more and more bodies were occupying space in these hills and thinking, for a variety of reasons, that it was theirs.
The Intermingling
Thomas Shirley died without a will in 1846; too bad for his heirs. But a long nightmare was also just beginning for anyone who had bought, thought they had bought or had been granted, or wanted to buy property in the by now intertwined Barbour-ShirleyFairfax lands. Conflicting ownership claims, tax sale disputes, and pardon the term, ‘squatter’s rights’ all intermingled. Wow, talk about an Excedrin headache! Madison County, among others, gradually sold off the disputed parcels to straighten things out. There are likely some residual disputed titles that linger to the present.
