WHEREAS on the 21st day of July, 1981, the Honorable Thomas J. Wilson, Judge of the United States Bankruptcy Court for the Western District of Virginia entered an Order abandoning the hereinafter described property as property of the estate of Roy E Berry. Jr pursuant to 11 U.S.C. S554. relieving the plaintiff from the stay of 11 U.S.C. S362 (a) (3). and granting leave to' proceed to recover said property from the debtor according to state law, NOW THEREFORE, in accordance with and pursuant to a Decree entered September 17, 1980 in the cause styled "Estate of Ann L Sutphin vs Roy E. Berry, Jr , et. ux.,’" Chancery No 3005 in the Circuit Court of Rappahannock County. Virginia, whereby the undersigned was appointed a Special Commissioner of said Court to sell" the hereinafter described property at public auction. NOTICE IS HEREBY GIVEN that on Saturday. August 8. 1981. at 10:00 a m on the front steps of the Courthouse at Washington, Virginia. I shall sell the following described tract of land to the highest bidder All that certain tract or parcel of land containing approximately 9.15 acres, more or less, in Jackson Magisterial District, Rappahannock County, Virginia, on the west side of State Route 642, about one mile southwest of the Village of Amissville, and being the same property conveyed by deed dated September 10, 1977 from Orelia A. Berry to Roy E. Berry, Jr. recorded among the land records of the Circuit Court of Rappahannock County in Deed Book 125 at page 376, LESS AND EXCEPT the portion thereof containing 5.09 acres conveyed to William Mort Colvin, et. ux, by deed from Roy E. Berry, et. ux. in Deed Book 131 at page 400. Reference to said deeds is hereby made for a metes and bounds description of the tract to be sold. The said 9.15 acres shall be . sold subject to all conditions, covenants, restrictions, and easements of record or visible upon the property as the same may lawfully apply thereto The terms of sale are ten percent (10%) of the sale price required on the date of sale with the balance thereof payable thirty (30) days from the date of sale. All payments must be cash or certified collectable funds
