Baumgardner recalled that he’d been asked in the past only if Miller’s being mayor of the town of Washington posed a conflict of interest to his serving on the school board. As regards to that office, there is no conflict, he explained, since the town is a separate jurisdiction from the county.
Baumgardner also noted that there was no “taint of illegality’’ to the supervisors’ action in appointing Eastham to the welfare board. State law requires only that he either resign from the school board or elect not to take the welfare appointment.
Miller was out of the county this week and Eastham could not be reached on Tuesday for a response to the attorney general’s opinion. The commonwealth’s attorney ( indicated, however, that Eastham told him he would refuse appointment to the welfare board. Baumgardner declined to comment on what Miller's decision will be—whether to resign from the school board or from the planning commission.
