Estes, McClyborn and McFarland bad been at the Hampton Inn across the street until approximately 10 pm. when they left to take McFarland's brother Gerte to his home in Sperryville. The three stopped at the restaurant on their return to buy cigarettes.
While Estes was in the establishment, Ridgeway and Jenkins, who had been barred from the Hampton Inn at an earlier date, yelled insults from across the highw ay.
