nal approval to Clyde and Lillie Pullen to build a single family dwelling in a floodplain in Old Hollow near Sperryville. The Pullens must have a certified engineer test the soil percolation and get approval from the health department for the septic tank system.
Konick told the board that the entire lot is within a floodplain and has floodplain soil according to the maps, but that no one remembers there ever being a flood there. “The church has been there for several hundred years,” he said, “And it’s still there.”
The board agreed that if the Pullens could prove that the land was unlikely to flood they could build there.
Second Dwellings
Controversy surrounded a request from Jack Atkins of Amissville for a special use permit to build a second single family dwelling on his 78 acre tract on Route 211.
Konick and the board had each received anonymous letters opposing the permit. “Nice to know you have a few enemies,” Atkins remarked. Bird pointed out that the board could not consider unsigned letters in making its decision.
Atkins’ tract had been split by contruction of Route 211 and he wanted to build a second house on the opposite side of the road from his present home.
Board member Peter Kramer said he would like to make an inspection of the site before voting because the area “is a scenic vista and there is sentiment against building in the area.” Kramer added, “structures and . density have a great impact on this area.”
Konick argued it w'ould be “a bad precedent to say a house hurts the view. It’s not like a 250 foot tower. You didn’t ask anyone else who came here today if the neighbors didn’t like the view of their houses. I just think it’s a bad precedent to say that somebody who drives by might say, ‘Golly! That sure would be a nice view if it wasn’t for that
