What the board will ask is that the SCC review whether it has jurisdiction under present state law even when a power line is less than 200 KV and if the commission determines it does not, to seek an attorney general opinion.
At the same time, county officials will meet with Delegate Raymond Guest and ask him to introduce legislation to lower the limit on SCC review powers from 200 KV to 100 KV. The committee presented two draft amendments to the state code which would do that. The bills would be introduced when the General Assembly convenes in January. The committee expects PotEd’s current project through Rappahannock to be covered by any new law.
