Testimony received at ^ last week’s meeting will be included in the record and another hearing will be scheduled after the presentation so the public will have the opportunity to respond. The BZA members would subpoena additional expert witnesses as they felt were needed.
“What we’ve heard today has not been wasted time by any means,” Bird concluded.
In a later interview, Bird said he thought the scenic vista question was “pretty open and shut” but that he would welcome testimony on the loss of taxable value at future hearings, particularly from real estate professionals. Bird said he agreed that some stood in peril of loss of property rights because of air wave interference. He gave the example of the ham radio operator “enjoying the use of air space,” citing the traditional holding that a landowner has control “down to the middle of the earth and up to the highest heaven.”
Bird repeated his concern that proper procedures be followed in case of possible future litigation.
Many citizens attending the meeting were not pleased by the delay and would ave preferred to see the application rejected outright. But they felt their side would prevail in the end. Said Vincent Day, “I think they (MCI) see the public sentiment was against them.”
