He added that the BZA members should consider the legal precedent they would be setting were they to approve the application. Once MCI is allowed to erect a tower, other telecommunications companies will be entitled to the same considerations, Reynolds said.
Further environmental damage could be caused by powerfline maintenance and construction people trekking up and down the old fire road on the side of the mountain, according to the attorney.
Reynolds added that he had spoken with MCI’s chief engineer who told him the company doesn’t have its permits in Culpeper yet.
