Perry Lewis Creel told Judge John Alexander that he was swerving at 25 mph at 2:30 a.m. because he had two passengers in his small Honda. Under questioning by Commonwealth Attorney Peter Luke, Creel, accused of a second offense of driving while intoxicated, denied being under the influence and offered no explanation for a staggered walk and slurred speech at the time of his arrest, Sergeant Todd Brown of the Rappahannock County Sheriffs Department stated that Creel failed his sobriety test and Alcasensor test.
The Court accepted the findings of a second breath test, rather than one taken at the scene, which showed Creel’s blood alcohol level under the legal limit. The Court ruled Creel guilty of Improper Driving and fined him $25 with $20 in costs.
