A Return was filed in the county cleric’s office on October 24 by Lee Bird, chairman of the Board of Zoning Appeals, responding to a Writ of Certiorari issued by the circuit court for Patricia Sal tons tall. The writ was issued on October 18, and the board had 10 days in which to submit transcripts of those meetings in which the issue was discussed, and to make any response.
In addition to the transcripts of the board’s meetings on October 12, 1983, August 22, 1984, and September 26,1984, the Return also contained the minutes of the October 12 meeting. At issue is a decision made by the BZA on September 26 that placed a house built on one of SaltonstaU’s lots in violation of the zoning ordinance.
Bird responded in tl|e Return to arguments made in Saltonstall’s writ on a point-by-point basis. The first response involved a question about the board’s decision not to allow evidence to be submitted by Saltonstall’s attorney, Doug Baumgardner, at the September 26 meeting.
