on the Nov. 6 ballot would simply allow the legislature to remove “outdated language,” the VML said.
The second question on the ballot is: “Shall the Constitution of Virginia be amended to require a balanced State budget?”
Although the state has been operating under a balanced budget procedure, it “is not clearly spelled out in the constitution,” according to a memorandum from the Virginia League of Women Voters.
‘The proposed change would add language to clearly spell out a requirement that is already implied in the constitution,” the league wrote.
Randy Cook, staff attorney for the division of legislative services, said the process now requires the governor to submit a budget in which expenditures do not exceed revenues or anticipated revenues. In effect, he said, that is a balanced budget.
Such language is included in the Appropriations Act, according to Mr. Banks.
“A ‘yes’ vote on the ballot question is to add the balanced budget requirement to the Constitution itself,” Mr. Banks wrote. “A W vote will mean that a balanced budget will continue to be a matter or custom and legislative provisions at each legislative session.”
The current constitution, approved in 1971, was last amended in 1982.
