To remove the cloud hanging over Bryant Lee’s appointment to the School Board, the Rappahannock Board of Supervisors will repeat the public hearing process on Monday, Oct. 19, and again consider nominees for representative from Hampton District.
The move comes at the recommendation of Commonwealth’s Attorney Peter Luke who found Mr. Lee’s appointment possibly invalid under a revision to the Virginia Code which took effect six days prior to the board’s action.
Supervisor Newbill Miller’s choice, Bryant Lee, was not one of the five candidates from the earlier public hearing; his name, in fact, had not been mentioned. That presented no legal impediment in June, but by the time of his actual appointment in July, the rules had changed. As Mr. Luke explained, a sentence had been added by the General Assembly to the regulations governing School Board appointments and it stipulated that whoever was appointed had to have been considered at the required public hearing.
