Commonwealth’s Attorney Peter Luke. He also faces a maximum fine of $102,250, $100,000 for the malicious wounding and $2,500 for the assault. The assault charge was amended from an original charge of attempted malicious wounding.

Mr. Sisk pleaded guilty to maliciously wounding Ernest Fletcher on Dec. 31, 1994. Mr. Fletcher died in March. According to Michael Starks, who was with Mr. Fletcher that night, they saw Mr. Sisk at the 211 Quicke Mart the night of the incident. He said that inside the store he heard Mr. Fletcher say to Mr. Sisk, “You are bigger than me and I know you can beat my ass.”

They all went outside, and Mr. Starks advised Mr. Fletcher to get in his car, which he did not do, saying that he wanted to. talk to Mr. Sisk. Then he saw Mr. Sisk hit Mr. Fletcher “with a left and then a right upper cut.” Mr. Sisk used brass knuckles, and Mr. Fletcher was bleeding from the back of his head. Mr. Fletcher required four stitches, and had a broken right scapula and a broken right rib, according to Mr. Luke.

George Freeman, Mr. Sisk’s attorney, said that his client did not remember using brass knuckles, but admitted that he may not remember because he had been drinking.

The autopsy on Mr. Fletcher was performed in Washington, D.C., and in court last Thursday, Mr. Luke informed the court of the results of the autopsy which he just recently received. He said that according to Dr. Germeniuk, the blow to Mr. Fletcher’s head on Dec. 31, 1994 was not the cause of his death.

During the autopsy, a subdural hematoma was found in the front of Mr. Fletcher’s head that could not have been bleeding for more than three or four days prior to his death, and that was what caused his death. “We did check out the aspect that it might have been a homicide,” said Mr. Luke,

Mr. Luke said that Mr. Fletcher had a problem with alcohol, and that a bump on the head could cause the bleeding inside because the liver does not produce the clotting factors that it
