Truth be told, there is no good reason for illegal dumping. It is simply a way for the “dumper” to more quickly dispose of unwanted trash or debris without taking the time and making the necessary effort to dispose of it properly and in accordance with county regulations and aggravate everyone else in the process.
County Attorney Peter Luke suggested to the Board of Supervisors, in light of a recent case of illegal dumping, that stricter penalties should be imposed on those who are guilty of illegal dumping. Mr. Luke suggested bringing the issue to the attention of the next General Assembly session and perhaps working to change the zoning regulations, which are seriously outdated, in order to ensure a harsher penalty. As it stands now, illegal dumping is only a Class III misdemeanor under the zoning regulations.
Under the County’s trash ordinance and state dumping laws, illegal dumping is a Class I misdemeanor, carries up to $2500 in fines and the guilty party can spend up to 12 months in jail. The down side is part of those fines go to the state and not the county.
Civil penalties under the zoning ordinance can be prosecuted more quickly however the current ordinance has no teeth.
Stiffer penalties would most likely result in less illegal dumping. The debris and trash would be disposed of properly and the situation for all concerned would improve.
