Davis Ruling

Last year. Commonwealth Attorney George Davis advised the School Board that state and federal funds would have to be provided for upgrading the elementary sewage lagoon as long as the system continued to meet the effluent standards under which the school’s original permit was issued.

However, at the September Board meeting, Bloomer reported that a recent opinion from Attorney General Marshall Coleman held otherwise.

According to Bloomer, Coleman ruled that the provisions of law relied upon by Davis in his advice to the Board did not apply to school systems. Further, said Bloomer, school systems are not eligible for federal grant money for sewer projects.
