Warner proceeded to walk over to them and shake hands with John Jenkins. He then told them all that he was sick of them and to leave, Warner testified. Warner went on to explain that “I was so scared 1 just wanted those guys gone.” The men ceased fighting and left the property a few minutes later, he added.
Laura Whorton, who lives behind the Corner Store, said s,>e was sweeping her front porch when the incident occurred in the early morning on July 4. Whorton stated that the first time Atkins pulled into the parking lot, the boys had a drink together because she saw the liquor bottle on the hood of Atkins' truck.
Irvin Jenkins came into the lot shortly after Atkins had arrived, she continued. Upon arriving, Atkins apparently started to harass Irvin and Whorton says she heard Irvin say “Go on Wayne, I1' don’t want to fuss with you again, that happened a long time ago." At which point, Whorton testified, she told all the boys to go home. They did disperse but when Wayne left he said "I'm going home to get a gun and I'll be back," according to the witness.
