In closing arguments. Commonwealth’s Attorney Doug Baumgardner stated that self-defense entails a duty to retreat using only such force as is reasonable to rebut an attack. Baumgardner pointed out that at some point, Irvin Jenkins changed from being the victim to the agressor.
Sharon Luke, attorney for the defendant, countered that Irvin Jenkins responded in self-defense. Luke went on to say that “Atkins was looking for a fight and interjected a gun so the situation could have been worse than it was.”
