In response to the complaint on FOI violation lodged by the newspaper, Baumgardner himself requested copies of the architectural reports, acknowledging that he planned to make the documents available to the News. The board denied his request.

Baumgardner then countered with a suggestion that the board act jointly with him to ask for an Attorney General’s ruling on (1) whether the superintendent of schools qualifies as a chief executive officers of a political subdivision (2) when reports cease to fall in the category of working documents and (3) whether the architectural reports were exempt from disclosure on the grounds that they were prepared exclusively for executive session.

The school board turned down the commonwealth’s attorneys suggestion, reportedly acting on the advice of special legal counsel Phillip Stone.
