questions regarding possible effects of the landfill operation, the attorney noted there is no evidence of any stream pollution in the area. "It doesn’t seem like there would be any problem,” he said, basing his opinion on the soil types at the dump site.

In the past five years, only 1V« acres of the eight acre tract has been used for trash disposal, according to Fletcher.

"In another five years, it would be appropriate for the board to review the landfill operation... Anything less than a five year period, the review would be a nuisance on Mr. Clark’s part,’’ Fletcher maintained.

Bird suggested that the BZA ask the state health department to re-evaluate the landfill site and determine how much longer it can be used and what limitations, if any, should be observed.

Fletcher countered that no matter what time limit the BZA sets on the permit—five or 25 years—“the state could come in next month and say it doesn’t meet their requirements and close it down.” He mainlined that to relocate the dump would cost the county “a great deal more money ’ in transportation expenses. With the county’s contract with Community Trash extending until June. 1984, “we’re obviously not going to stop the landfill operation at this point," noted Bird. Agreeing to ask the health department's Bureau of Solid Waste and Vector Control to update its original evaluation of the landfill site, the BZA voted to extend the dump permit for five years or such shorter period as the state may deem appropriate.
