Rappahannock's Commonwealth's Attorney has asked the Circuit Court to name a special prosecutor to litigate second degree murder charges lodged against Diane Elizabeth Kidwell.
Douglas K. Baumgardner announced Tuesday that he disqualified himself January 18 from prosecuting Kidwell for the shooting death of Ranee Spellman Nov. 9.
"I take this action after consultation with Judge (Thomas) Horne and Ms. Rhetta M. Allen, assistant counsel to the Virginia State Bar,” Mr. Baumgardner noted.
According to a letter from Ms. Allen (marked “personal and confidential” but released by Mr. Baumgardner). ihe Commonwealth’s Attorney wrote the Virginia State Bar January 3, requesting an opinion on the propriety of his continued service in connection with the Kidwell case. “It is my opinion that a
