Saying that the Commonwealth had not carried the burden of proving C.H. Dodson, Jr. guilty of failure to report an accident and giving false information to a police officer. General District Court Judge John Alexander granted defense attorney David Konick’s motion to strike the charges on January 11.
The charges stemmed from a July 4 accident in which Dodson struck a pedestrian with his pick-up. Trooper Rufus Baines investigated the accident after a call from the Culpeper police. After speaking to members of the Amissvile Rescue Squad, Baines went to Dodson’s home.
Baiq.es testified that Dodson acknowledged the accident and took him to the scene. But investigation by Baines determined that the accident had taken place at a spot a tenth of a mile down the road.
In further questioning, Baines testified, Dodson revised his description of the accident, saying that the victim had been a passenger
