“It’s a question of how to skin the cat,” Commonwealth’s Attorney Douglas Baumgardner said of attempts to have developers shoulder the cost of expensive shooting range inspections.
A proposed zoning ordinance amendment which would allow shooting ranges as a special permit use in agricultural zones calls for (I) safety and sound testing by qualified experts to ensure that performance standards are met and (2) the applicant to pay for that testing. \
At an informal joi nj meeting last Wednes-tfay between county planning commissioners and supervisors Dick Latham and Hubert Gilkey, Baumgardner questioned whether stateenabling legislation allows cost of testing and inspections to be assessed directly on the permit applicant.
"It’s a viable goal. . .to have the applicant bear the costs of studies to satisfy local government that safety features are included,” he said.
