Neither the victim nor other passengers were called as witnesses by the commonwealth. Konick objected to testimony by Baines as to the victim’s version of the accident. The judge upheld his objection.
Konick made his motion to strike on the grounds that Baines had gone to Dodson's house with obvious knowledge of the accident, relieving the defendant of an obligation to report it. The false information as to the exact circumstances and place of the accident, Konick said, did not benefit Dodson in any way since he freely admitted to the accident.
