Bird said the board’s vote was based on the belief that “the impact on the county as a whole to have two family units on 25 acres would be inconsistent with the zoning ordinance. However, Mrs. Saltonstall’s desire to save prime farm land is admirable and should be encouraged.”

Kidwell, Krebser Opposed

Speaking against the special use application were neighbor Roger Kidwell and planning commissioner Werner Krebser.

Kidwell was concerned that a private road for the duplexes had already been built and had cut him off from his alleged riparian rights. Kidwell also objected to the precedent that could be set by allowing multifamily rental property in an agricultural area.

H. Ben Jones, attorney for Saltonstall, ' characterized the first two of Kidwell’s objections as “private matters not up to the BZA,” noting that a right of way dispute between Kidwell and Saltonstall is currently under litigation.

Krebser testified that multi-family dwellings in a conservation district would be contrary to both the present and proposed zoning ordinances. Furthermore, according to Krebser, the county might be required to upgrade the private road to state standards should future residents in the subdivision petition the highway department to take over maintenance.
