As The Child Care and Learning Center prepares to face the Board of Zoning Appeals (BZA) for the second time next Wednesday with its request for a variance from the setback requirements of the present zoning ordinance, key figures in the on-going debate struggle with the meaning of hardship as defined by Virginia law.
Some History
The Center has appeared before the Planning Commission, before the BZA, and before the Planning Commission again.
BZA members, at the June meeting, had asked that the request be returned to the planners for more clarification. Members had heard arguments from Zoning Administrator David Konick, who said the request involved a change in representation both in applying for the subdivision and for the special-use permit needed to operate a school in a residential area.
