The main arguments, however, centered around the finding of a hardship, required by law, in order to grant a variance.
The law states, in part, that the “granting of such variance will alleviate a clearly demonstrable hardship approaching confiscation, as distinguished from a special privilege or convenience sought by the applicant."
The Child Care and Learning Center maintained before the two county boards that the poor drainage of the non-conforming lot they had selected had required a change in plans. Further, they said, they had expected the new ordinance to be in effect by the time they started building.
Further compounding the hardship, Center spokesmen said, is the fact that the school presently is pressed for space, pushed to begin as soon as possible with their new building, and in danger of losing money and
