Attorney David Konick wants the Rappahannock supervisors to vacate a subdivision plat which he alleges was approved illegally nine years ago.

The request, to be lodged at next Monday’s board meeting, is the latest skirmish in the on-going battle between the county and Sperryville landowners Ivan and Hazel Hall.

On behalf of the Halls, Mr. Konick petitioned the Circuit Court in May 1985 to review and overturn the Rappahannock Board of Zoning Appeals’ decision to grant the Sperryville Assembly of God Church a special use permit and variance for a new house of worship and parsonage on 12.8 acres the church had con. tracted to buy from Oscar Lozano.

The site is adjacent to the Halls’ 26 acres with a family dwelling, ex■ tensive truck garden, seasonal roadside stand and farm ponds, where Mr. Hall breeds freshwater game fish.
