In a second letter dated March 19, Judge Robertson again took exception to Mr. Konick’s position. He maintained that the attorney’s argument (1) assumed that the subdivision is a legal nullity before that question has been resolved and (2) speculated inappropriately on what the Board of Supervisors would do. As to the right of appeal in Rappahannock’s subdivision ordinance, Judge Robertson noted that this “right” exceeded authority allowed under state law.
On Monday, Mr. Konick asked to be put on the agenda for the next supervisors meeting to present an application for the vacation of the subdivision plat and request that the matter be referred to the planning commission.
