In Rappahannock, subdivisions of up to three parcels in Agricultural zones are handled administratively by Mr. McCarthy’s office as long as all parcels are at least 25 acres. To create more lots a special exception is required.
Special exceptions are also being used to keep more space open by clustering residential lots in Agricultural zones. Under this last provision subdividers are allowed to cut off lots that are smaller than 25 acres as long as the average density is one house per 25 acres or more. The Board of Supervisors has enforced this by requiring that the deed on the remaining residue state that its development potential has been reduced by the allowed subdivision.
If the bill passed, presumably there would be nothing to keep the county from being divided into 25acre parcels. However, ironically, unless Rappahannock’s Zoning Ordinance was amended, in fact, any parcel could only be cut into three lots, each 25 acres or larger regardless of the size of the original parcel, Mr. McCarthy said. He added that he would expect pressure to amend the zoning ordinance.
