Jacobson described the county procedure as a means of downzoning land. A developer is then “required to argue his way back,” he said.
Georgia Herbert, a member of the Fauquier County Board of Supervisors, defended the county’s use of the special exception, explaining it as “a mechanism by which developers can increase the number of houses they can build."
“I find that surprising to say the least,” responded Jacobson.
“It is used to authorize larger projects than are authorized by right,” Herbert said.
She described the system as three-tiered. A landowner may be permitted to go beyond the by-right zoning through the special exception rule. To receive more than the maximum permitted density, the landowner must apply for a rezoning.
With disagreement as to the purpose of the special exception tool among their concerns, legislators opted to wait a year before acting on the bill.
