McCarthy noted that the use of the special exception — that usually involves a public hearing and some give-andtake — has not resulted in any applications being turned down.
Holding hearings where neighbors could point out the effects new construction would have on their property has been helpful over the years, according to McCarthy.
“It is a useful tool for getting all of the facts out,” said McCarthy. “And we would negotiate some design changes, if necessary.”
“The argument that (the special exception) reduced numbers or stifled activity won’t wash, either,” he added. “And if we ever took over 90 days to approve an application, it was because it had other problems.”
